Commission Terms and Conditions

Effective Date: The date of payment or deposit by the Client
Artist: Twumato or Mato
Client: Any individual or entity that commissions artwork from Twumato.These Terms and Conditions ("Agreement") govern the commission of digital artwork ("Work") by the Artist ("Artist") for the Client ("Client"). By requesting, commissioning, or purchasing artwork from the Artist, the Client agrees to the following terms:1. General Terms
✦ The terms provided at the time of payment or invoicing are the terms that will apply to the commission.
✦ By submitting payment, the Client confirms that they have read, understood, and agreed to these terms.
✦ The Artist reserves the right to cancel a commission at any time if the Client fails to follow these terms.
✦ The Artist will not create artwork containing or promoting:
- ✧ Violence, harassment, or hate speech
- ✧ Heavy mecha or extreme gore, Anthro NSFW or underage NSFW
- ✧ Art styles imitating other artists Hyperrealism or realistic portraits
- ✧ Controversial or sensitive topics (e.g. politics, racism, etc.)
✦ Commission requests are added to the Artist’s work queue in order of payment. If the Client does not respond within 7 days of inquiry or confirmation, the request will be automatically cancelled.2. Payment Terms
✦ Full or partial payment is required upfront before work begins.
✦ Listed prices serve as base rates and are subject to change based on complexity or specific requests.
✦ Additional fees apply for complex elements such as:
- ✧ Armor, weapons, intricate accessories
- ✧ Horns or fantasy features
- ✧ Detailed textured clothing or backgrounds3. Waitlist Deposit
✦ A 5% non-refundable deposit is required to reserve a commission slot on the Artist’s waitlist.
✦ This deposit is applied to the final total cost of the commission.
✦ If the Artist cancels the commission, the deposit will be fully refunded.
✦ If the Client cancels, the deposit is forfeited.
✦ The remaining balance must be paid before the final delivery of the artwork.4. Revisions and Edits
✦ Revisions are included with each update or work-in-progress (WIP) shared with the Client.
✦ Excessive revisions or requests that significantly alter previously approved work may incur additional fees.
✦ Revisions to areas that have already been explicitly approved are not included and will be charged separately.
✦ The Artist reserves the right to deny revision requests that violate artistic integrity or project feasibility.5. Deadlines and Delivery
✦ Completion time varies depending on the Artist's workload and the complexity of the project.
✦ The standard turnaround time is up to 1–3 months, unless otherwise communicated or specified in the proposal.
✦ If the Client requires a specific deadline, this must be communicated prior to payment.
✦ The Artist will work on commissions in the order they are received and will provide updates as appropriate.
✦ Failure to respond promptly to updates may delay the completion timeline.
✦ Any delays or changes to the agreed timeline will be discussed with the Client.6. Usage Rights and Ownership6.1 Artist’s Rights
✦ The Artist retains full rights and ownership of all commissioned artwork for personal use, promotion, and portfolio display.
✦ The Artist may post the commissioned work to their social media, gallery, or website unless otherwise agreed upon.6.2 Client’s Rights
✦ The Client may display the commissioned work on personal platforms, such as websites, social media, or streaming channels.
✦ The Client may not claim the work as their own or alter it without permission.
✦ The Client may crop, add text, or animate the artwork for personal non-commercial use.
✦ Requests for alternate versions must be included in the original commission agreement.6.3 Commercial Use
✦ Content Use (e.g., streaming, advertising, thumbnails): Allowed as long as there is no direct monetization of the artwork itself.
✦ Full Commercial Use (e.g., merchandise, prints, or resale): Requires an explicit agreement and may involve an additional fee. This must be indicated at the time of commission.6.4 Prohibited Use
✦ The Client may not use the commissioned work for:
- ✧ NFT or blockchain-related purposes
- ✧ AI training or AI-generated content
- ✧ Crypto projects or imaging platforms7. Intellectual Property
✦ All artwork remains the intellectual property of the Artist.
✦ The Client is granted a limited license to use the commissioned work in accordance with the agreed usage terms.
✦ Unauthorized reproduction, sale, or redistribution is strictly prohibited.8. Refund Policy
✦ No refunds will be issued once work on the commission has begun.Full refunds are available only if:
- ✧ The commission is cancelled before work has started
- ✧ The Artist cancels the project for personal or health reasons
- ✧ The work is not delivered by the agreed deadline9. Communication
